PURCHASE CONDITIONS

1. Object

These general conditions of purchase (hereinafter, the "Conditions"), are applicable to the cosmetic products (the "Products" or the "Product") offered by LABORATORIOS NATUROLEO, S.L. through their website www.naturoleo.com (the "Website").

The Website is owned by LABORATORIOS NATUROLEO S.L. with Tax Identification Number B73977670 (VAT-ID ESB73977670) and tax domicile at Avda. Golf, 5 - 3ºC, 30506 MOLINA DE SEGURA (Murcia). It is registered in the Commercial Register of Murcia, Volume 3274, Folio 161, Inscription 1 with sheet MU-91788,

LABORATORIOS NATUROLEO S.L. markets its products under the trademark NATUROLEO COSMETICS; this trademark is registered and legally protected within international scope.

LABORATORIOS NATUROLEO S.L. ("LABORATORIOS NATUROLEO") provides information concerning the Products and offers the possibility of acquiring them through their Website. People with the intention of buying Products must complete the corresponding registration form prior to the purchase process and follow the instructions provided by LABORATORIOS NATUROLEO S.L. in the Website.

These Conditions, together with the Website Legal Notice, are the only ones to be applied to the use of the Website and the purchase of the Products through it. These replace any other conditions. Consequently, Clients (the "Client") accessing, registering or buying Products through the Website accept these Conditions and they are bound by these ones and the Legal Notice, in the way they are written in the moment in which the Website is accessed.

Every Client who accesses to the Website and registers on it must have, at least, eighteen (18) years old. Otherwise, the Client must have a parental or guardian consent.

The contract is formalized in Spanish and it is regulated by the Spanish legislation. In particular, by the Royal Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws ("LDCyU") and by the Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce ("LSSI").

2. Information about Products

Pictures, graphic or iconographic representations and videos related to LABORATORIOS NATUROLEO Products, as well as trade names, trademarks or distinctive signs of any kind in the Website, are intended to provide the most descriptive information about the Products. LABORATORIOS NATUROLEO will take all reasonable precautions to ensure that the Products’ descriptions which appear on the Website are correct. However, the Client must take into account that these serve as a guide and, consequently, lack exhaustive nature. For this reason, Products’ descriptions and images are not guaranteed to be exact, complete, reliable, up-to-date or free of mistakes.

LABORATORIOS NATUROLEO reserves the right to decide, at any time, which Products they offer through the Website. Thus, LABORATORIOS NATUROLEO may, at any time, delete or add Products, understanding, unless otherwise provided, that the new Products will be governed by the provisions of the Conditions that are in force at that particular time.

In the event that a Product is not available once a purchase has been made, due to circumstances of force majeure, LABORATORIOS NATUROLEO will inform the Customer of the total or partial cancellation of the order by email. In turn, the Customer will be entitled to have a refund. The partial cancellation of the order does not entitle the annulment of the entire order, without prejudice to the exercise of the right of withdrawal corresponding to the Client in accordance with the provisions of these Conditions.

3. Placing an order

To place an order, the customer must follow a series of simple instructions that appear on the Website.

Customers must select the products they want to buy, per pack or individually, according to the product and the desired format. Once the choice of the products has been completed, clients must click on the "Add to Cart" button. These products will be automatically added to the customer's shopping cart, located in the upper right corner. The shopping cart indicates the price of the added products. Clients can consult all their shopping cart items at any time.

The process of adding other products to the cart will be done in the same way.

Once the purchase is finished, customers must click on their cart (located in the upper right corner). The purchase summary will be displayed and, then, they will have to press the "Finish Purchase" button.

Customers must create an account to be able to place an order. If they are new users, they must fill in the required fields in the login. If they are already registered, they must click on the registered customer tab and enter their email address and password.

Once the products have been selected, the customer must choose the payment method. If the client has a promotional code, he/she must enter it at that moment so that the corresponding discount can be applied before the payment. Credit card, Paypal or bank transfer are allowed for order shipments.

Customers will see a detailed summary of their purchase: the products and the quantities they have ordered, the total price (including taxes and shipping costs), the shipping address or the address of our warehouse (for orders with collection in stock), the form of payment, the form of delivery and a field where the customer can write details regarding the order. All this data can be modified through the modifier button (located next to the different sections of the order details). In case of making the payment by bank transfer, customers can see the bank account number, where they must make the payment, below the order details.

Finally, customers must press the Confirm Purchase button, located below the order details. They will receive a confirmation e-mail.

When formalizing an order, the Client acknowledges and declares to have read all the instructions taken during the verification process and accepts these Conditions in full. The Client formalizes an order of Products through the Website by clicking on the "Place the Order" button at the end of the purchase process.

Once the order is sent, a page with the phrase "Thank you for your purchase" will appear. Within 24 hours after the acceptance by LABORATORIOS NATUROLEO, the Customer will receive an acknowledgment of receipt at the email address that he / she has provided to LABORATORIOS NATUROLEO, confirming their acceptance along with a summary of the conditions, information about the characteristics of the Products purchased, the price, the form of payment and the information about the shipping costs.

If an order confirmation does not arrive within 24 hours after its formalization, being proficient the day following the formalization of the order, Customers can contact LABORATORIOS NATUROLEO to get assistance. They can do it by sending an email to the address [email protected] or by calling +34 644 267 890. Clients may also contact LABORATORIOS NATUROLEO when having doubts regarding an order. For a faster service, Users are advised to have their order number available.

4. Shipping and delivery

Orders are processed and delivered on business days and during the hours of service to the public from 8 am to 6 pm. Orders placed outside of business hours on Fridays or on weekends and holidays will be processed the following business day.

Customers must pay the shipping costs which are reflected in the receipt. When the purchase price equals or exceeds the amount of 150.00€, the shipping will be fully covered by LABORATORIOS NATUROLEO, leaving the customer exempt from this expense.

The maximum delivery time of the Products is 30 calendar days from the conclusion of the contract. Once the payment has been confirmed by the Customer, shipments take approximately between 2 to 6 business days in Spain (peninsula). The delivery time might vary between 3 to 7 business days for international shipments, depending on the destination and the chosen service and transport company. Once the package is delivered to the messaging service, the Customer will receive an email notice with the tracking number of the shipment.

LABORATORIOS NATUROLEO is not responsible for delays in the delivery of orders or for the impossibility of making them when the cause is due to force majeure and, thus, out of control of LABORATORIOS NATUROLEO. Among other causes, the company understands that there is force majeure in the following cases, not exhaustive: accidents, strikes, riots, threats or terrorist attacks, fire or explosion, weather causes or natural disasters such as storms, floods, earthquakes, subsidence, epidemics, as well as any other problem outside of LABORATORIOS NATUROLEO regarding means of transport or telecommunication systems. As far as possible, once the cause of impossibility or delay is over, LABORATORIOS NATUROLEO will do whatever to resume its commercial activities and be able to fulfill its obligations and shipments.

All purchases are subject to prior authorization from the bank. Only purchases with prior authorization will be processed. If the order cannot be processed, the Customer will receive an email.

5. Form of payment

The forms of payment accepted by LABORATORIOS NATUROLEO are the following:

a) Credit Card

The following forms of payment will be accepted:

  • Visa
  • MasterCard
  • American Express

Products will be charged once the order takes place. For Client's security, the name and billing address of the Customer must match those of the credit card used to make the payment. The company reserves the right to cancel any order that does not meet this criteria.

All credit card holders are subject to validation and authorization checks by the card issuer. If the issuer of the Client’s payment card denies, or for any reason does not authorize the payment on the company’s behalf, either prior to or after a payment, the company will not respond for any delay or failure to deliver.

b) Paypal

Paypal linked to your debit, credit or bank account card. Paypal does not apply costs except in the case of currency conversion.

c) Bank Transfer

Once the payment is made, the Client must send the payment receipt indicating his order number to the email [email protected].

The order will only be sent once the transfer has been received, or in its absence, the document accrediting it.

6. Shipping costs

The shipping costs are based on the number of purchased products and the destination.

The Canary Islands, Ceuta and Melilla are not part of the customs territory of the European Union, thus, those shipments may be subject to taxes and / or customs duties.

In most cases, the fees are charged when the package is delivered, although it is possible that the Customer receives a mail notice asking them to personally address these fees in order to receive the package. The amount of the fees may vary according to the weight / amount of the package. In the case of shipments to the Canary Islands, LABORATORIOS NATUROLEO includes the Single Administrative Document ("DUA") for export in the cost of the shipment, and upon Product’s delivery, the Client / recipient must pay the Import DUA and the Indirect General Tax. Canary ("IGIC").

7. Inquires about orders

Notwithstanding the provisions of point 4 of these Conditions, Customers who have created an account at www.naturoleo.com will be able to check the status of their orders by visiting the "My Orders" page in the "My Account" section.

When the Clients click on the "Status of my Order" page, they will be required to access with their email address and password. In the “order summary” page, Clients will be informed in detail about their current and previous orders. Once the order is sent, the corresponding tracking number will be displayed, if available.

8. Cancellation of orders

LABORATORIOS NATUROLEO may cancel the orders because of the following non-exhaustive reasons:

  • Impossibility to process the payment information.

  • Impossibility of delivery at the address provided.

  • Cancellation at the Customer's request.

  • Items are not available.

9. Other purchase characteristics

Shipments are made by courier service.

The shipping costs include the Value Added Tax (VAT) in all cases.

Delivery is understood as the delivery of the Products at the address specified by the Customer during the process of placing the order.

LABORATORIOS NATUROLEO delivers the orders to the courier service within a maximum period of 48 hours.

10. Right of withdrawal

Customers may exercise the right of withdrawal without indicating any reason. They can return the Product to LABORATORIOS NATUROLEO within a period of fourteen (14) days since the arrival of the Product. The Product cannot be opened, used and it has to be in perfect condition, as it was received.

For the withdrawal, the Customer have to notify LABORATORIOS NATUROLEO by writing to the e-mail address [email protected], indicating the required data to locate the order in question. Once LABORATORIOS NATUROLEO receives the email with the order details, the Client can be informed about the procedure to be followed.

11. Effects of withdrawal

The Customer must send the Product, in perfect condition, to the address indicated by LABORATORIOS NATUROLEO, no later than fourteen (14) calendar days from the date on which it communicates the decision of withdrawal to LABORATORIOS NATUROLEO. In these cases, LABORATORIOS NATUROLEO will reimburse the costs of the original purchase to the Customer, with the exception of the direct cost of returning the Products, which will be assumed by the Customer. Likewise, the Client shall only be held liable for the decrease in value of items resulting from handling the items in a different way than that which is established due to their nature, characteristics or functioning.

LABORATORIOS NATUROLEO will use the same means of payment selected by the Client when doing the initial transaction. LABORATORIOS NATUROLEO can withhold reimbursement until the returned Product (s) has been received or until the Customer provides proof of having returned the Product (s). It depends on what happens first.

12. Guarantee

LABORATORIOS NATUROLEO is responsible for the lack of conformity shown in the Product for a period of three (3) months from the delivery. Therefore, if the Product is defective, LABORATORIOS NATUROLEO will pick it up and exchange it for another of identical conditions, taking charge of the costs associated with this return and exchange (except for those additional expenses resulting from choosing an express delivery method. In this case, the Customer must assume the extra cost).

In order to manage the incident, the Customer must notify LABORATORIOS NATUROLEO the reason for the incident, the order number, the delivery note, as well as photographs of the damaged or erroneous product by email to the address [email protected] so that the situation can be assessed. In order to exercise the right of guarantee, the proof of purchase or delivery note must be available.

Once this information is received, LABORATORIOS NATUROLEO will contact the Client explaining the procedure to follow.

The Client must inform LABORATORIOS NATUROLEO about a lack of conformity with the Product within a period of fifteen (15) days after realizing about it.

In the event that the Product cannot be objectively replaced by another of the same class, LABORATORIOS NATUROLEO will proceed to refund its price.

In no case the guarantee provided in point 12 will cover the negligent or violent use of the Product or the damages derived from the manipulation or intervention of it.

It is equally important to follow the instructions for the use or installation of the Products delivered, and in case of doubt, Clients should contact LABORATORIOS NATUROLEO to receive advice on the use of the Product.

13. Taxes

In all cases, the prices include the Value Added Tax (VAT), as well as any tax or rate that may be applicable.

14. Prices

The Products will be sold at the indicated price, and the one which is in force once the Client confirms the delivery.

15. Validity

LABORATORIOS NATUROLEO reserves the right to modify prices, articles, offers and other commercial conditions without prior notice.

16. Resignation

If LABORATORIOS NATUROLEO lacks the requirement of Clients’ strict compliance of any of their obligations assumed under a contract or of these Conditions or if it does not exercise its rights or actions that could correspond to the contact or the Conditions, any resignation or limitation in relation to said rights or actions will not be implied or Clients will not be exonerated from complying such obligations.

No resignation by LABORATORIOS NATUROLEO of a specific right or action will imply a resignation of other rights or actions derived from a contract or from the Conditions.

17. Modification of Conditions

LABORATORIOS NATUROLEO reserves the right to revise and modify these Conditions at any time. Customers will be subject to these Conditions in force once they use the Website or make an order, unless LABORATORIOS NATUROLEO had to make retroactively changes in these Conditions by law or governmental decision. In this case, the possible changes will also affect the orders that the Customer had previously made.

18. Claims, comments and suggestions

Clients are provided with a claim form that can be requested by sending an email to [email protected].

Likewise, Customers can communicate any doubt, suggestion or comment to our Customer Service during customer service hours at the email address [email protected] or by phone +34 644 267 890.

19. Data Protection

For the purposes of the provisions of the Organic Law 15/1999, of December 13, on the Protection of Personal Data ("LOPD"), LABORATORIOS NATUROLEO informs the Client that any personal data provided at any time and on a voluntary basis to the company or our employees will be included in an automated file of personal data, which is created and maintained under the responsibility of LABORATORIOS NATUROLEO. This data will be treated with the sole purpose of processing order requests, as well as queries or suggestions made by the Client.

Clients may exercise their right of access, rectification, cancellation and opposition at any time by addressing their requests to the e-mail address [email protected].

In order to up-to-date and make sure that the information of our files does not contain mistakes, we ask Clients to inform us about the modifications and rectifications of their personal data as soon as possible.

We inform our Clients that all security measures of a technical and organizational nature have been adopted to guarantee the protection of their personal data and to prevent their alteration, loss, treatment and / or unauthorized access, taking into account the state of the technique, the nature of the data stored and the risks to which they are exposed. All in accordance with the provisions of the LOPD and its Development Regulations.

Except in the fields where expressly stated otherwise, the delivery of information required in the data request forms is mandatory for the proper management of orders, queries and suggestions made by the Client. The lack of completion of the fields determined as mandatory, or the provision of incorrect data, will make it impossible for LABORATORIOS NATUROLEO to correctly manage them.

20. Applicable Law and Jurisdiction

These Conditions are governed and interpreted in accordance with the Spanish law.

The parts agree to submit the decision of the matter raised to the Courts and Tribunals of the city of Murcia (Spain).
